We, the members of the Macomb Police Department, have designed this area of the web site in order to better educate the members of our community.  This area mirrors an informational  pamphlet that is designed to raise awareness about City Ordinance violations.

We hope that with this information you will become aware of what is expected of you as a citizen and what fines may be imposed for violation of our city's ordinances.  This is not an all inclusive listing, but merely a short list of the most common ordinance violations.

Alcohol & Identification Violations

 

4-97(d)  Misrepresents Age to Enter Class "T" Tavern

A person under the age of 20 shall not use any type of documentation that shows he/she    is at 20 years of age in order to gain admission to a tavern/bar.  This includes the common violation of "pass backs."  ($250.00 minimum)

4-97(e)  Possession of False Identification

A person under the age of 21 shall not possess any type of documentation/identification whether altered, fictitious, or belonging to another for the purpose of purchasing or attempting to purchase alcoholic liquor.  ($250.00 minimum)

4-98      Assisting a Minor in Misrepresentation of Age

It shall be unlawful for any person to assist a minor in misrepresenting his/her age for the purpose of entering a Class "T" Tavern/bar or for the purpose of obtaining any alcoholic liquor.  This includes people who "pass back" their identification to minors ($250.00 minimum)

4-95     Possession / Consumption of Alcohol by a Minor

The purchase, acceptance, possession, or consumption of alcohol by a minor is prohibited ($250.00 minimum)

4-96     Sale or Delivery of Alcohol to a Minor

The sale or delivery of alcohol to a minor is prohibited ($250.00 minimum)

4-94     Person Under 20 Years of Age in a Class "A" Tavern

No person under the age of 20 years shall be in a Class "A" Tavern/bar.  A person under the age of 20 may be in a Class "E" Tavern/bar until the business' posted time ($250.00 minimum)

4-115c Possession of Open Alcohol in Public

The possession of open alcohol in public (i.e. any non-sealed container that contains any type of alcoholic beverage) is prohibited in public areas.  A public area is defined as public properties, sidewalks, streets and alleys, and the area between a sidewalk and street ($250.00 minimum)

 

Liquor Violations (Common to "House Parties")

 

4-51(a)   Sale of Alcohol Without a License

No person shall sell any type of alcoholic beverage without obtaining a liquor license ($500.00 minimum)

4-51(b)   Sale of Alcohol After Being Purchased at Retail

No person shall resell or offer for resale any alcoholic liquor that had been purchased or obtained from a retail liquor business ($500 minimum)

4-114      Keg Registration

All kegs that have been purchased or obtained from a liquor business and contain an alcoholic liquor shall contain a keg registration sticker.  Removal of such sticker is prohibited except by a liquor retail business.  Kegs may not be transported to residences other than the one used for keg registration at the liquor retail business ($100.00)

 

Common City Ordinance Violations

16-15     Prohibited Noises / Loud Music

Loud music, and other loud noises, is prohibited.  There is no set time that either is allowed. ($100.00 minimum)

16-16     Loud Gatherings / Loud Parties

Loud gatherings or parties are prohibited.  Multiple contacts with the police will result in the party being shut down and citations being issued ($100.00 minimum)

**Macomb Police policy / procedure regarding enforcement of loud music and/or party complaints:  all loud music / loud party calls are complaint driven.  This means that someone had called the police asking for enforcement of the ordinance.  The police will not arrive at loud parties or at areas with loud music unless they have received a complaint from a citizen.  The police will not tell the violators who called in the complaint.  Although, most violators usually wish to apologize to the caller, a few incidents of vandalism has created this necessity. 

Based on a valid complaint, the Macomb Police will issue one (1) written warning per semester per address.  After that one warning, subsequent valid complaints will result in a city ordinance citation being issued.

What is a valid complaint and how do I avoid one?

When the Macomb Police arrives in the general area of a complaint, he/she will make a determination as to the validity of the complaint.  The police determine if a call is valid by listening for music (16-15) or voices, laughing, yelling, etc (16-16).  If an officer hears music or people's voices from a "common area" such as, a sidewalk, street, or hallway in an apartment building, then the complaint is determined to be valid.

You can avoid a valid complaint by taking a few seconds to see if you can hear the music or voices from the closest street, sidewalk or hallway inside an apartment building.  If you can, and the police are called, you could be subject to a written warning and / or citation.

16-31     Resisting, Obstructing, and / or Interfering with a City Official (Police)

It is unlawful to resist, obstruct, or otherwise interfere with the police during his/her official duties ($100.00 minimum

**Discussion at City Council meetings suggests this fine will increase**

16-51     Urinating or Defecating in Public

Urinating and / or defecating in public is prohibited ($100.00 minimum)

16-12     Fighting

Fighting amongst two or more individuals in any public place is prohibited ($250.00 minimum

16-54     Possession of Cannabis Less than 10 Grams

No person shall possess cannabis anywhere in the City.  Amounts of cannabis of 10 grams or more and / or possession of drug paraphernalia will result in state cannabis charges ($250.00 minimum)

 

Miscellaneous City Ordinances

15-20     Skateboarding / Bicycling on Sidewalks

Skateboarding or bicycling on sidewalks is prohibited near the Macomb Square area.  Signs are posted ($25.00)

16-2        Curfew

            Any person under the age of 18.

            12:01 AM to 6:00 AM Saturday and Sunday

            11:00 PM to 6:00 AM the following day Sunday through Thursday

16-76     Tampering with Signs

Tampering with any sign, particularly street signs, is prohibited ($75.00)

16-32     Impersonating a City Employee

It is unlawful to impersonate a city employee ($75.00)

PM301.9  Indoor Furniture Outdoors

Indoor furniture is prohibited outdoors or on outdoor porches ($75.00)

20-11     Games & Other Activities on Streets and Sidewalks

It is unlawful to play games or other activities on public streets and sidewalks where such activities interfere with pedestrians and / or traffic ($75.00)

 

Fire Prevention & Protection

10-2     Outside Burning

The outside burning of garbage, grass clippings, leaves, construction material, furniture, and other rubbish is prohibited ($75.00 minimum)

10-5     Evacuation of Buildings

All residents / occupants shall evacuate any building in which a fire alarm has been activated or when directed to evacuate by an official agent of the federal, state, county, city, or university ($75.00)

10-131 Possession of Fireworks

The possession of explosive fireworks is prohibited ($75.00 plus confiscation of fireworks)

10-132 Discharge of Fireworks

The discharging of explosive fireworks is prohibited ($75.00 plus confiscation of fireworks)

 

Animals

6-6      Noisy Animals

Noisy animals and barking dogs are prohibited ($75.00)

6-32    Dogs Running at Large

Dogs running at large are prohibited.  Dogs outside must be leashed, restricted from leaving the owner's property, or in control of the owner while outdoors.  Dogs observed running loose may be picked up and taken to the McDonough County Animal Shelter ($75.00)

 

Garbage

20-2     Littering

Littering is prohibited ($75.00)

11-2     Accumulation of Refuse / Garbage

The accumulation of refuse / garbage is prohibited.  Refuse / garbage is to be properly contained and set out for weekly collection ($75.00)

11-4     Windblown Refuse / Garbage

Refuse / garbage that has been blown about the yard shall be picked up by the responsible party ($75.00)

11-10   Outside Burning of Refuse / Garbage

The outside burning of refuse / garbage is prohibited.  Refuse / garbage is to be collected in a container and placed at the curb for weekly pickup ($75.00)

 

Parking Ordinances

15-213A1B    No Parking on a Public Sidewalk

Parking on public sidewalk is prohibited ($20.00 if paid within 14 days / $40 if after 14 days of issuance)

15-213A1I      No Parking Where Official Sign Prohibits

Parking where official sign prohibits parking (i.e. "No Parking Any Time" or "No Parking 2 AM to 6 AM" is prohibited ($20.00 if paid within 14 days / $40 if after 14 days of issuance)

*Contrary to some, the prohibited parking from 2 AM to 6 AM Monday and Friday mornings is not to encourage visitors of taverns to drive home to avoid a parking ticket.  The prohibited parking allows the Street Sweeper to properly clean the streets and downtown square.

15-213A2A    No Parking In Front of a Public / Private Driveway.

No parking in front of public or private driveways ($20.00 if paid within 14 days / $40 if after 14 days of issuance)

15-214            No Parking on Dirt or Grassy Areas (i.e. in yards)

Parking is not allowed in grassy or dirt areas on private property ($20.00 if paid within 14 days / $40 if after 14 days of issuance)

15-318           No Parking For Over 24 Hours

Vehicles parked for over 24 hours in one spot will be ticketed and then towed 24 hours later ($20/$40 as above plus tow service fee and administrative fees.  See Schedule of Fees)

15-223           No Parking on Private Property

Vehicles parked on someone else's property will be ticketed and are eligible to be towed at the vehicle owner's expense ($25/$50 plus tow service fee and administrative fees.  See Schedule of Fees)

15-224           No Parking in Alleys

Parking in Alleys is prohibited ($20.00 if paid within 14 days / $40 if after 14 days of issuance, plus tow service fee and administrative fees.  See Schedule of Fees)

15-231           Manner of Parking

Vehicles parked more than twelve (12) inches away from the curb or vehicles parked with the driver's side closest to the curb are prohibited ($20.00 if paid within 14 days / $40 if after 14 days of issuance)
